VZ Direct wants you to be familiar with how we collect, use and disclose information. This Privacy Policy describes our practices in connection with information that we collect online and offline:
- through our website (“Website”);
- through social media properties (“Our Social Media”) from which you are accessing this Privacy Policy;
- through HTML-formatted email messages that we send to you that link to this Privacy Policy (“Emails”);
- through services we provide (“Services”);
- through any other offline business interactions you may have with us (“Offline Interactions); and
- through our surveys or assessments (“Assessments”).
Collectively, we refer to the Website, Our Social Media, Emails, Services, Offline Interactions, and Assessments as the “Services.”

“Personal Information” is information that identifies you as an individual or relates to an identifiable individual, such as:

- Email address (personal and business)

We need to collect Personal Information in order to provide any requested Services to you. If you do not provide the information requested, we may not be able to provide the Services. If you disclose any Personal Information relating to other people to us or to our service providers in connection with the Services, you represent that you have the authority to do so and to permit us to use the information in accordance with this Privacy Policy.

We and our service providers use Personal Information only for legitimate business purposes, including:
- Providing the functionality of the Services and fulfilling your requests.

- To perform Assessments or surveys and share the results with you.

OTHER INFORMATION
“Other Information” is any information that does not reveal your specific identity or does not directly relate to an identifiable individual

- Demographic information and other information provided by you that does not reveal your specific identity;
- Employment industry, education level and salary range; and
- Information that has been aggregated in a manner such that it no longer reveals your specific identity.
- If we are required to treat Other Information as Personal Information under applicable law, then we may use and disclose it for the purposes for which we use and disclose Personal Information as detailed in this Policy.
We and our service providers may collect Other Information in a variety of ways, including:
- Through your browser or device:
- Certain information is collected by most browsers or automatically through your device, such as your Media Access Control (MAC) address, computer type (Windows or Mac), screen resolution, operating system name and version, device manufacturer and model, language, Internet browser type and version and the name and version of the Services (such as the App) you are using. We use this information to ensure that the Services function properly.\
- Using cookies
- Cookies are pieces of information stored directly on the computer that you are using. Cookies allow us to collect information such as browser type, time spent on the Services, pages visited, language preferences and other traffic data. For further information about cookies visit allaboutcookies.org. We do not currently respond to browser do-not-track signals. However, some third-party websites do keep track of your browsing activities. If you are visiting such websites, you can set your preferences in your web browser to inform websites you do not want to be tracked. You can enable Do Not Track by visiting the preferences or setting page of your web browser.
- Analytics.
- We use Google Analytics, which uses cookies and similar technologies to collect and analyze information about use of the Services and report on activities and trends. This service may also collect information regarding the use of other websites, apps and online resources. - IP Address
- Your IP address is automatically assigned to your computer by your Internet Service Provider. An IP address may be identified and logged automatically in our server log files whenever a user accesses the Services, along with the time of the visit and the page(s) that were visited. Collecting IP addresses is standard practice and is done automatically by many websites, applications and other services. We use IP addresses for purposes such as calculating usage levels, diagnosing server problems and administering the Services. We may also derive your approximate location from your IP address.
SECURITY
We seek to use reasonable organizational, technical and administrative measures to protect Personal Information within our organization. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure, please immediately notify us in accordance with the “Contacting Us” section below.
CHOICES AND ACCESS
You have choices regarding marketing-related communications. If you no longer want to receive marketing-related emails from us on a going-forward basis, you may opt-out by following the unsubscribe instructions in any such message or by contacting us by email at sales@vanderzielmachinery.com. We will try to comply with your request(s) as soon as reasonably practicable. Please note that if you opt-out of receiving marketing-related emails from us, we may still send you important administrative messages,from which you cannot opt-out.
If you would like to request to review, correct, update, suppress/delete, or object to or restrict processing of Personal Information that you have previously provided to us, or if you would like to request to receive an electronic copy of your Personal Information for purposes of transmitting it to another company, please feel free to contact us in accordance with “Contacting Us” section below. We will respond to your request consistent with applicable law.
In your request, please make clear what Personal Information you would like to have changed, whether you would like to have your Personal Information suppressed from our database or otherwise let us know what limitations you would like to put on our use of your Personal Information. For your protection, we may need to verify your identity before implementing your request. We will try to comply with your request as soon as reasonably practicable.
RETENTION PERIOD
We retain Personal Information for as long as needed or permitted in light of the purpose(s) for which it was obtained and consistent with applicable law.
THIRD-PARTY SERVICES
This Privacy Policy does not address, and we are not responsible for, the privacy, information or other practices of any third parties.
This includes any third-party operating any website or service to which the Services link. The inclusion of a link on the Services does not imply endorsement of the linked site or service by us or by our affiliates.
In addition, we are not responsible for the information collection, use, disclosure or security policies or practices of other organizations, such as Facebook, Apple, Google, Microsoft, RIM or any other app developer, app provider, social media platform provider, operating system provider, wireless service provider or device manufacturer, including with respect to any Personal Information you disclose to other organizations through or in connection with the Apps or our Social Media.
USE OF SERVICES BY MINORS
The Services are not directed to individuals under the age of eighteen (18), and we do not knowingly collect Personal Information from individuals under 18.
COPPA
The Children’s Online Privacy Protection Act (COPPA) was passed to give parents increased control over what information is collected from their children online and how such information is used. The law applies to websites and services directed to, and which knowingly collect information from, children under the age of 13. VZ Direct’s Services are not directed to children under the age of 13, nor is information knowingly collected from them.
CALIFORNIA CONSUMER PRIVACY ACT
To the extent that the California Consumer Privacy Act (CCPA) is applicable to either party: (i) such party agrees to comply with all of its obligation under the CCPA; and (ii) in relation to any communication of “personal information” (as defined by the CCPA) from one party to the other party pursuant to this privacy policy, the parties agree that no monetary or other valuable consideration is being provided for such personal information and therefore neither party is “selling” (as defined by the CCPA) personal information to the other party.
GDPR COMPLIANCE
The European General Data Protection Regulation (“GDPR”) imposes specific obligations on a Covered Entity with regard to its relationships with individuals or entities engaged in Processing of Personal Data, as those terms are defined in Article 4 of the GDPR. For purposes of this section, the term GDPR includes Regulation (EU) 2016/679, together with any additional implementing legislation, rules or regulations that are issued by applicable supervisory authorities. Words and phrases in this section shall have the meanings given to them in Article 4 of the GDPR. b. While the parties do not intend and do not anticipate exchanging data in scope of GDPR, in the event that the Business Associate is or becomes engaged in the Processing of Personal Data, the Business Associate shall be deemed a Processor and shall comply with all requirements under the GDPR which are applicable to Processors of Personal Data.
SENSITIVE INFORMATION
We ask that you not send us, and you not disclose, any sensitive Personal Information (e.g., social security numbers, information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic characteristics, criminal background or trade union membership) on or through the Services or otherwise to us.
LINKS TO OTHER SITES
Our Services may contain links to other sites that are not operated by us. If you click on a third-party link, you will be directed to that third party’s site. We strongly advise you to review the privacy policy of every site you visit.
We have no control over and assume no responsibility for the content, privacy policies or practices of any third-party sites or services.
ADVERTISING
We may use your personal data to contact you with newsletters, marketing or promotional materials and other information that may be of interest to you. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions in any email we send or by Contacting Us.
PAYMENTS
VZ Direct does not directly collect or store payment information. We may use Stripe (“STRIPE”) as our third-party service provider for payment services (e.g. card acceptance and related services). By using the Services, you agree to be bound by Stripe’s Privacy Policy and hereby consent and authorize VZ Direct to share any information and payment instructions you provide with one or more third party service provider(s) to the minimum extent required to complete your transactions.
UPDATES TO THIS PRIVACY POLICY
The “LAST UPDATED” legend at the top of this Privacy Policy indicates when this Privacy Policy was last revised. Any changes will become effective when we post the revised Privacy Policy on the Services. Your use of the Services following these changes means that you accept the revised Privacy Policy.
